Terms of Service

1. Who we are

InSapientia, s.r.o., Company ID (IČO) 06735894, registered office at Korunní 2569/108, Vinohrady, 101 00 Prague 10, Czech Republic, registered in the Commercial Register kept by the Municipal Court in Prague, Section C, Insert 288020 (“we”, “us”). Contact: [email protected]. Pengo is our personal finance app, available at app.pengo.money.

2. What Pengo is

Pengo is “local-first” software: all your financial data is processed and stored exclusively on your device, encrypted with your password. We don't operate a server where your data would reside, and we have no access to it. Pengo is a personal overview tool: it is not financial, investment, or tax advice, and we are not a payment service provider.

Environment and portability. Pengo runs in a current version of Chrome, Edge, Safari, or Firefox, and as an installed app on macOS, Windows, Android, and iOS. It stores data in your browser's or device's storage. The only way to move it to another device is a backup from the app, because we have no access to it ourselves. The license key is tied to the name you choose, not to a device, and is verified offline; there is no DRM in Pengo that would lock you out of the content after some period.

3. Free and Plus versions

The basic version (Free) is free of charge and lets you manage 2 accounts; no other features are limited. For the Free version we grant you a free, non-exclusive, non-transferable license to use the app for personal purposes on your own devices; you may not redistribute or resell the app. The Plus version is a one-time paid license that unlocks an unlimited number of accounts and future features marked as Plus. Free version limits apply only when creating new accounts, never retroactively to existing data.

4. Purchase

The seller of the Plus license is Paddle.com Market Ltd, reg. no. 8172165, 30 Old Bailey, London EC4M 7AU, United Kingdom, which resells it as Merchant of Record; if you're buying from the US or Canada, the seller is Paddle.com Inc. or Paddle.com (Canada) Ltd, respectively. You therefore enter into the purchase agreement with Paddle: Paddle issues your tax invoice and remits VAT or sales tax according to your country. InSapientia grants you the license to use Pengo under point 5 of these Terms. In addition to these Terms, Paddle's Buyer Terms and Refund Policy apply to the purchase. The price is always shown including tax before you complete the purchase.

5. Plus license

By paying, you receive a non-exclusive, perpetual license to use the Plus features for personal use (yours and your household's), on any number of your own devices. The license key carries the name you choose when you collect it. You must not publish the key or make it available outside your household. The license works offline: the app does not connect to the internet to verify it. We provide the updates needed to keep Pengo free of defects for at least two years from purchase. If a sole trader or company purchases the license, only one designated individual may use it, for their own personal overview, not as a company accounting system.

6. Right of withdrawal and refunds

Statutory right of withdrawal. Pengo Plus is digital content that is made available to you immediately after payment. When you confirm at checkout that you want performance to begin immediately, and acknowledge that this extinguishes your statutory right of withdrawal, your right to withdraw from the contract under Section 1837(l) of the Czech Civil Code lapses once the license key is made available. Paddle, as the seller, shows you this consent and notice before you complete the purchase.

Our contractual guarantee beyond your statutory rights. Regardless of that, we'll refund the full price within 14 days of purchase if you change your mind, no reason needed, even if you've already used the key. This is our contractual commitment, not a statutory deadline; we arrange the refund with Paddle ourselves. You'll find the process on the Refund Policy page. You can claim the guarantee with any clear statement, most simply by email to [email protected]; you may also use the model withdrawal form under Government Regulation No. 29/2023 Coll.

Other rights. Your rights arising from defective performance for digital content (Section 2389a et seq. of the Czech Civil Code) and any other rights the law grants you as a consumer are not affected. Report any defect in the app to [email protected].

7. Your data and backups

Your data belongs to you alone. Losing your password means an irreversible loss of data: we have no way to recover it; that is precisely what the protection consists of. That's why we strongly recommend using the encrypted backups the app offers, and storing them off-device too.

Please note that data stored only in the browser can be lost if browser data is deleted or the device fails. This does not limit any liability the law places on us. We're simply telling you where the risk lies that we cannot control.

8. Defects and liability

We are liable for Pengo conforming to the contract under Section 2389a et seq. of the Czech Civil Code, including the updates needed to keep the app free of defects. Report a defect to [email protected] and we'll resolve it without undue delay. We'll confirm receipt of your complaint by email, stating the date, a description of the defect, and the resolution you're requesting. We will resolve the complaint within 30 days at the latest and notify you of the outcome. Complaints about the payment itself or refunds are handled by Paddle as the seller. Write to us and we'll help you get it sorted.

Pengo is a personal overview tool, not an accounting or tax system. For important decisions, verify the numbers against the source. But that doesn't mean we're disclaiming responsibility: we do not exclude or limit our statutory liability for defects or for damages.

9. Changes to these Terms

We may only change these Terms for a reasonable cause: a change in the law, a change in how the app works technically, or a new feature. We will publish the new version on this page with its effective date and announce material changes on the website.

For a license you've already purchased, the Terms in effect on the date of purchase apply. A later change applies to you only if you accept it. We never narrow the scope of what you bought (point 5).

10. Governing law and disputes

These Terms are governed by the laws of the Czech Republic. If you are a consumer habitually resident in another country, this choice of law does not affect you to the extent of the protection given to you by the law of your country.

Any consumer dispute with us can be resolved out of court at the Czech Trade Inspection Authority, Central Inspectorate, ADR Department, Gorazdova 1969/24, 120 00 Prague 2, email [email protected], website coi.gov.cz/informace-o-adr/. You can file a request if the dispute could not be resolved directly with us; the proceedings are free of charge for consumers.

But we'd be glad if you reached out to us first. We can resolve most things directly.
